Malaga Bank FSB (the "Bank", "we", "us" or "our") is committed to respecting the privacy rights of all users ("you" or "your") of its web site (the "Site"). Certain information about visitors to this site is being collected by DHI Computing Services, Inc., 1525 West 820 North, Provo, UT 84601 on their web servers. The following policy describes how the Bank seeks to assure its visitors about how it protects information provided or collected through this Site.

What information do we collect about you and how do we use it? When applying to use our Online Banking Site, you are required to provide your name, e-mail address, street address and telephone number, social security number, and your account number(s). Later, you will be asked to create a password to access the online banking services ("Services") offered on our Site. This information allows us to keep a user profile so that we may provide you access to the Services, customize preferences, and provide a faster method for you to submit and receive information to and from us.

We may also collect general information in connection with your use of our Site, such as, for example, the length of time you spend on our site, what pages on our site you visit most frequently, how often you visit our site, what kind of browser software you are using, and your domain name, if applicable. If you communicate with us by e-mail, we may collect your e-mail address and any other information contained in the e-mail. Since e-mail transmissions may be subject to interception, please do not include sensitive or personal information in any e-mail you send to us.

Information is collected for the purpose of processing your application, transaction, or request for information. The information will be used for the purposes of meeting your banking needs and requests, and providing services to you in the future. The Bank does not share customer information with third parties, except as permitted by law such as to service your accounts.

How do we protect your information? The Bank implements a variety of security measures to maintain the safety of the information you provide to us. Your information is contained behind secured networks and is only accessible by a limited number of employees who have special access rights to such systems. All sensitive information supplied by users is transmitted via Secure Socket Layer (SSL) transaction security protocol (which was developed by Netscape and is now largely accepted as an industry standard) and then encrypted into the Bank's databases. The Bank recommends using one of the following browsers, each of which can be downloaded free of charge: Google Chrome ('http://www.google.com/chrome'), or Microsoft Internet Explorer ('http://www.microsoft.com/ie'). To ensure the highest level of security available today, the Bank suggests that users choose the 128-bit encryption version from the download options. If a user does not have access to a browser that supports at least 48-bit encryption, the Bank's servers will not process such user's information.

You may review the information we collect about you and correct any errors in that information by reviewing account statements and any other correspondence from us and notifying us of any inaccurate or outdated information at the address or phone number on your statements.

Furthermore, if the Bank chooses to make chat rooms, forums, message boards, individual web pages, and/or news groups available to its users, please remember that any information that is disclosed in these areas becomes public information and each user should exercise caution when deciding to disclose any of his/her information.

Do we use "cookies"? Cookies are bits of electronic information that a Site can transfer to a user's hard drive to help tailor and keep records of a user's visit to a Site. Cookies allow web site operators to better customize visits to a web site to the user's individual preferences. The use of cookies is standard on the Internet and many major web sites use them. Although most web browsers automatically accept cookies, users can usually change browser settings to prevent or provide notification whenever a cookie is sent, thereby giving users the chance to decide whether or not to accept it. OUR SPECIAL NOTE TO PARENTS
Due to the nature of the high-end services offered on our Site, and lack of marketing toward children, we believe that children are unlikely to visit us on the Internet. Nonetheless, we encourage parents and guardians to spend time online with their children, and to participate in the interactive activities offered online. No information should be submitted to or posted at our Site by guests under eighteen (18) years of age without the consent and supervision of their parent or guardian. In addition, we will use our best efforts to comply with the Federal Children's Online Privacy Protection Act (COPPA). In an effort to comply with COPPA, we will not knowingly allow children under the age of thirteen to use our Site.

However, we also believe that it is the parents' responsibility to supervise their children's online activities and parents should therefore consider using parental control tools available from online services and software manufacturers that help provide a child-friendly online environment. These tools can also prevent children from disclosing their name, address, and other personal information online without parental permission.

Entire Agreement

This Agreement contains the entire agreement between the parties and no statements, promises or inducements made by either party or agent of either party that are not contained in this written Agreement or other documents referenced by this Agreement.

Choice of Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State of California, except where preempted by federal law.

Amendment of this Agreement

We may amend, add to or change this Agreement (including changes in its fees and charges hereunder). We will provide notice of amendments, additions or changes if required by applicable law. Your continued use of the Services will constitute your consent to the amendments, additions or changes.

Additional Terms and Conditions

Waiver. We may waive any term or provision of this Agreement at any time or from time to time, but any such waiver shall not be deemed a waiver of the term or provision in the future.

Assignment. We may assign the rights and delegate the duties under this Agreement to a company affiliated with us or to any other party. You may not assign your rights or obligations under this Agreement, and any effort by you to do so is unenforceable at our election.

Termination; Suspension; Delay. Except to the extent restricted by law, we reserve the right to terminate or to discontinue support of any Service, or delay or refuse processing any transaction, without written notice. You may terminate this Agreement upon 30 days written notice to us. Termination of this Agreement will not affect any rights we may have, or any obligations you may have, as to any transaction or Services caused or attempted by you before termination.

  • We also highly recommend that you have a personal firewall, virus and spyware protection that is up-to-date with all security patches and that the operating system is also up-to-date with all security patches.

SAFEGUARDING YOUR INFORMATION

At Malaga Bank, the security of customer information is a priority. We are strongly committed to the safety and confidentiality of your records. Every day, unscrupulous individuals are busy developing new scams targeting the unsuspecting public. One of the best ways to avoid fraud is to become an educated consumer.

  • Watch out for copycat Web sites that deliberately use a name or Web address very similar to, but not the same as the real one. The intent is to lure you into clicking through to their Web site and giving out your personal information, such as a bank account number, credit card number or Online Banking login information.
  • Always use your pre-established links to access Web sites and avoid clicking on links in unsolicited e-mails. If you ever receive a suspicious e-mail representing itself as Malaga Bank, please forward the message in its entirety to malagabank@malagabank.com.
  • Ensure that your own personal computer has updated anti-virus and firewall protections. Apply security patches for all of your programs and operating systems regularly.
  • Passwords should be unique to you and changed regularly. Do not use birthdays or other numbers or words that may be easy for others to guess. Never write down your password or give it to another person.
  • Monitor your account activity frequently using our free Online and Mobile Banking services.
  • Sign up for free Online Banking eStatements to avoid having your paper statement sitting in an unsecure mailbox where it could be compromised.
  • Set up free Security and Balance Alerts through Online Banking to be notified via e-mail when there is transaction activity or changes in your expected balance.
  • Set up a personalized Phishing Phrase for your Online Banking so that you always know when you are on our secure Web site.

Please keep in mind that we will never ask for or email you requesting your online banking password. We may on occasion call to verify other information regarding your online activity should we see something of concern in your login patterns.If you plan to travel and use your Online Banking or Debit Card, it is very helpful to call us in advance to avoid your account being temporarily disabled for security purposes.

REGULATION E

In Case of Errors or Questions About Your Electronic Transfers Telephone us at 310-375-9000 or Write us at 2514 Via Tejon, Palos Verdes Estates, CA 90274 as soon as you can, if you think your statement or receipt is wrong or if you need more information about a transfer listed on the statement or receipt. We must hear from you no later than 60 days after we sent the FIRST statement on which the problem or error appeared.

  1. Tell us your name and account number (if any).
  2. Describe the error or the transfer you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information.
  3. Tell us the dollar amount of the suspected error.

If you tell us orally, we may require that you send us your complaint or question in writing within 10 business days.

We will determine whether an error occurred within 10 business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 days to investigate your complaint or question. If we decide to do this, we will credit your account within 10 business days for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within 10 business days, we may not credit your account. For point-of-sale errors involving unauthorized use of a Visa Debit Card we will credit your account within five (5) business days while we investigate your complaint or question if your account is not new.

For errors involving new accounts, point-of-sale, or foreign-initiated transactions, we may take up to 90 days to investigate your complaint or question. For new accounts, we may take up to 20 business days to credit your account for the amount you think is in error.

We will tell you the results within three business days after completing our investigation. If we decide that there was no error, we will send you a written explanation.

You may ask for copies of the documents that we used in our investigation.

For personal accounts, limitations on your liability for unauthorized electronic funds transfers and other electronic errors that are covered by Regulation E are explained in the EFT Disclosure and in our Terms and Conditions Agreement. However, if you use online services for any business activity, you assume all risk of loss for unauthorized transfers and payments, and you must establish your own internal security procedures for employees you authorize to prevent all unauthorized use by other employees or persons.

In order to combat the increasingly savvy perpetrators of card fraud, our ATM and Debit cards now have around-the-clock protection with 24/7 FraudWatch® PLUS. FraudWatch® PLUS provides industry leading technology, tools and expertise to manage fraud. Experienced fraud analysts work around the clock, watching for any suspicious card activity and will contact you between the hours of 8 a.m. and 9 p.m., if they detect potential fraud on your card. So, if you receive a call from “Fraud Prevention Services,” please know that they are doing their job to prevent the potentially fraudulent use of your card.

The Fraud Protection Services analyst will never ask you for your full Social Security Number or your 4-digit PIN. To help identify you, the analyst will ask you for:

  • the last 8-digits of your card number
  • the last 4-digits of Social Security Number
  • your date of birth
  • your mother’s maiden name

They will then ask you to verify recent activity to determine if your card has been used fraudulently. Fraud is a serious business, and can hit any time of the day or night. That is why we are working to detect and prevent fraud from happening to you.
